Abstract:
How do norm clusters (structures) and fields of practice (agents) relate to one another, and how can they evolve across time and space? This excerpt from a larger book project on transitional justice – how societies address legacies of severe or widespread human rights violations – examines the interplay between structures, agents, decision-making, precedent, innovation, and acceptance or rejection by the community. It interrogates the place and role of creativity in that process: how do actors work with what has come before to make something (more or less) new, and what happens to the menu of options for the next entrant into the field? The theory is demonstrated by variety of quantitative and qualitative analyses, using existing and newly collected data, showing the co-evolution of transitional justice as both a field of practice and a norm cluster.
